This web site (the "Site") is operated by Elson & Robbins Limited (referred to in this Agreement as "Elson"). Elson & Robbins Limited is a company registered under the Companies Acts in England (No. 2745077) and having its registered office at Gloucester House, Wellington Street, Long Eaton, Nottingham NG10 4HT.

The Site is offered as a free service to you, the user. You have the opportunity to seek independent legal advice on this Agreement before continuing to use the Site if you wish. By continuing to use the Site you agree that you will be bound by the conditions in this Agreement.

If you decide subsequently to order any goods from Elson then this transaction will be subject to additional terms and conditions which will be supplied to you at the time.

1. Intellectual Property

All materials and content within the Site are copyright © 2001 Elson & Robbins Limited. Such materials may not be copied or reproduced, save to the extent necessary to view the same on-line. You may not sell or modify what is on the Site or reproduce, display, distribute or otherwise use the material on it in any way for any public or commercial use. Notwithstanding the above you may print complete pages of the Site to hardcopy for your own personal use.

All logos and names related to Elson & Robbins and Wade Spring are the property of Elson and all rights in such names and logos are reserved. Other product and company names mentioned on the Site or on other web sites accessed through the Site may be the trade marks of their respective owners.

The Site may contain hyperlinks to web sites operated by parties other than Elson. These hyperlinks are provided for reference only. Elson does not control these web sites and is not responsible for their contents. The inclusion of hyperlinks to these web sites does not imply any endorsement of the material on them or any association with their operators.

Elson reserves the right to remove any hyperlink at any time and without notice and shall not be obliged to give a reason for doing so. 3. Accuracy of Information - PLEASE READ CAREFULLY

The information in the Site is intended for customers of Elson in the United Kingdom and may not be applicable to customers in other jurisdictions. Elson will use reasonable endeavours to ensure that the contents of the Site are accurate and up to date. However, Elson cannot guarantee the accuracy of the Site and in addition Elson reserves the right to change product specifications at any time.

Nothing in this Clause 3 affects the statutory rights of any person dealing as a consumer nor shall anything in these terms and conditions exclude or limit liability for death or personal injury caused by negligence or for fraudulent misrepresentation.

4. Data Protection

Elson respects the privacy of every individual who visits the Site. This Clause 4 outlines the information, which Elson may collect and how it will be used.

Personal Data

Elson will not collect any personally identifiable information about you (including your name, address, telephone number, or email address) ("Personal Data") unless you provide it to Elson or any other associated company of Elson voluntarily.

If you do not want your Personal Data collected, please do not submit it. If you have already submitted it and would like it removed from our records, please contact us at the email address stated at the end of this Clause 4. We will use reasonable efforts to delete your information from our records.

If you provide Elson with Personal Data it will store this information about you now and in the future for purposes connected with its business, including market research, tracking of sales data, and in order to contact you. Elson may also disclose Personal Data to associated companies of Elson (including Wade Furniture Group Limited).

5. Law and Jurisdiction

The Site was created, and is operated, according to the laws of England. In determining any disputes in connection with or arising out of the use of the Site the laws of England will apply and the Courts of England and Wales will have exclusive jurisdiction.

6. Variation

Elson reserves the right to change the terms, conditions, and notices under which the Site is offered. Elson will do this by altering this Agreement on the Site and this alteration will then be of immediate effect. For this reason you should regularly visit this Agreement on Site as the current version will be binding on you.

7. General

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Elson as a result of this agreement or use of the Site. Each and every provision of this Agreement is separate and severable. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set out above, then the validity and enforceability of the remainder of the terms and conditions shall not be affected.

This Agreement constitutes the entire agreement between you and Elson with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Elson with respect to the Site (excluding any fraudulent representations). A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in charges, fees, duties, taxes, and assessments arising out of the use of the Site.
